Terms of Service

Welcome to Nest.APStudy ("the Service"). These Terms of Service ("Terms") govern your access to and use of the Service.

1. About the Service

Nest.APStudy is an academic planning and study management tool designed to help students organize their coursework, schedules, tasks, and study materials. The Service is provided as-is for personal, non-commercial, educational use.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

3. Account Registration and Responsibility

3.1 Account Creation

To use certain features of the Service, you must create an account. You may register using an email address and password or through a supported OAuth provider such as Google. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Choose a strong, unique password if using email/password authentication.
  • Not share your account credentials with any other person.
  • Notify us immediately at [email protected] if you believe your account has been compromised.

We are not liable for any loss or damage arising from your failure to secure your account.

3.3 One Account Per User

Each user should maintain only one account. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any illegal, fraudulent, or harmful purpose.
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems and infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Upload, transmit, or distribute any viruses, malware, or other harmful code.
  • Scrape, crawl, or use automated means to access the Service or extract data without our written permission.
  • Use the Service to harass, abuse, threaten, or intimidate any person.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use the Service to infringe on the intellectual property rights of others.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell, redistribute, or commercially exploit any part of the Service without our written permission.
  • Circumvent, disable, or interfere with security-related features of the Service.

5. User-Generated Content

5.1 Your Content

You retain ownership of all content you create, upload, or enter into the Service, including schedules, tasks, notes, study plans, and other academic data. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

5.2 Responsibility for Content

You are solely responsible for the content you create or upload. We do not monitor, review, or endorse user-generated content. You represent that you have the right to use any content you enter into the Service and that it does not violate any third party's rights.

6. Academic Data Disclaimer

Important: Nest.APStudy is an independent planning tool and is not affiliated with, endorsed by, or officially connected to any school, university, the College Board, or any other educational institution.

  • Course information, exam schedules, curriculum data, and other academic content displayed within the Service may be sourced from publicly available information and community contributions.
  • This data may be incomplete, outdated, or inaccurate. We make reasonable efforts to provide helpful information, but we cannot guarantee its accuracy or completeness.
  • You should always verify official course requirements, exam schedules, deadlines, and academic policies directly with your school, teacher, or the relevant official source, such as the College Board website for AP exam information.
  • Nest.APStudy is not a substitute for official academic advising, school counseling, or institutional records.
  • We are not responsible for any academic decisions you make based on information provided by the Service.

7. Service Availability

7.1 No Uptime Guarantee

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to:

  • Scheduled or unscheduled maintenance.
  • Software updates and deployments.
  • Server outages, infrastructure issues, or force majeure events.
  • Factors beyond our reasonable control.

7.2 Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users in advance of significant changes, but we are not obligated to maintain any particular feature or functionality.

7.3 Data Loss

While we implement reasonable backup and recovery procedures, we cannot guarantee that your data will never be lost. We strongly recommend maintaining your own backups of important academic information outside of the Service.

8. Suspension and Termination

8.1 By You

You may stop using the Service and delete your account at any time, as described in our Privacy Policy.

8.2 By Us

We reserve the right to suspend or terminate your account, at our sole discretion, if we reasonably believe that:

  • You have violated these Terms of Service.
  • Your use of the Service poses a security risk or may cause harm to other users or our infrastructure.
  • Your account is being used for abusive, fraudulent, or illegal purposes.
  • Continued provision of the Service to you is no longer commercially viable or legally permissible.

Where possible, we will provide notice and an explanation before or at the time of suspension or termination. In cases of severe or ongoing abuse, we may act immediately without prior notice.

8.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination, including Sections 9, 10, 11, and 12, will survive.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, code, features, branding, logos, and documentation, excluding user-generated content, is owned by Nest.APStudy and its creators and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our explicit written permission.

9.2 Feedback

If you provide us with suggestions, feedback, or ideas for improving the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and incorporate that feedback into the Service without any obligation to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • Warranties regarding the accuracy, reliability, or completeness of any content or data provided through the Service.

Your use of the Service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Nest.APStudy, its creators, contributors, or affiliates be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, use, goodwill, or other intangible losses.
  • Damages resulting from your access to or use of, or inability to access or use, the Service.
  • Damages resulting from any unauthorized access to or alteration of your data.
  • Damages resulting from any third-party conduct on the Service.

In no event shall our total liability to you for all claims arising from or related to the Service exceed the amount you have paid us in the twelve (12) months preceding the claim, or $0 (zero dollars) if you have not paid us anything.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nest.APStudy, its creators, contributors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third party's rights.
  • Any content you create or upload to the Service.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts located in the State of Georgia.

14. Data Deletion

You have the right to delete your account and all associated data at any time. Full details on how deletion works, what is deleted immediately, and what may be retained temporarily are provided in our Privacy Policy under the "Data Deletion and Account Deletion" section.

To request account deletion:

  1. Use the account deletion feature in your Account Settings, or
  2. Email [email protected] with the subject line "Account Deletion Request."

We will process all deletion requests within 30 days.

15. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nest.APStudy regarding your use of the Service and supersede all prior agreements, understandings, or representations.

18. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.
